Em torno da legitimação do judiciário: o regresso dos heliastas

Abstract

O presente trabalho versa a questão do poder judiciário nas sociedades contemporâneas de altas culturas e de capitalismo tardio. Depois de um posicionamento dos principais conceitos implicados e da conclusão da necessidade de legitimação de forte intensidade, regular e periódica, do exercício do poder judiciário como poder soberano criador de direito, critica-se os métodos de legitimação direta e indireta mais utilizados, com particular referência ao sistema eletivo dos juízes, à legitimação pela lei (designadamente a lei constitucional) à assim chamada legitimação pela fundamentação das decisões judiciais, à legitimação pelo júri à legitimação através da composição de conselhos superiores das magistraturas, à chamada legitimidade de exercício, etc. Finalmente, conclui-se pela proposta duma assembleia judiciária de eleição direta com a função de superintendência sobre todo o sistema judiciário, cujo modelo se inspira na antiga Helieia ateniense, e que se defende constituir a mais adaptada solução na contemporaneidade para o problema da falta de legitimidade do judiciário e, consequentemente, para o deficit democrático que esta representa, permitindo assim a fundação dum novo patamar na via da integralização da democracia, valor que informa e inspira esta dissertação. /ABSTRACT - The present essay tums on the issue of the judiciary power in high culture and late capitalism contemporaneous Societies. After presenting the main related concepts and concluding of the strong, regular and recurring need for legitimating the judiciary power exercise as a sovereign power creator of right, one criticizes the direct or indirect most commonly used methods of legitimating, particularly the judges elective system, the legitimating by the law (namely constitutional law), the so called legitimating on the grounds of judicial decisions, the jury legitimating, the legitimating through the composition of high magistrate councils, the so called legality exercise, and so on. Finally one concludes presenting the proposal for a judiciary council of direct election aiming to oversee the whole judiciary system, whose model is inspired in the ancient Athenian Helieia and considered to be nowadays the most adequate solution for the problem of the lack of judiciary legitimacy and, consequently, to the democratic deficit which it presents, thus allowing the foundations for a new path on the wholeness of democracy, the value which shapes and inspires this essay.
